Fair Work changes for Casual Employment

Fair Work recently brought in the new Casual Conversion Requirements.

 First, let us clarify some terms:

  • CEIS - Casual Employment Information Statement
  • Casual
    • no firm commitment to hours or pattern of work
    • receives a 25% casual loading on their hourly rate
    • does NOT receive Annual Leave or Personal (sick) Leave
  • Permanent
    • commitment to a pattern of work
    • can be:
      • Full time = 38 hours per week
      • Part time = pattern of hours per week
    • no 25% loading
    • does receive Annual Leave and Personal (sick) Leave

What does the new Casual Conversion Requirement mean to you the Employer:

There are some situations where you must offer a Casual Employee the opportunity to change to Permanent status (either Full Time or Part Time).

Small Business = less than 15 employees

  • Send CEIS now
  • Eligible Casual Employees may request to be converted to Permanent (full time or part time)
  • There is no requirement for you to offer conversion to Permanent
  • All new Casuals must be given the CEIS upon employment

Other Business = 15 or more employees

  • Send CEIS to current Casuals immediately after 27th September 2021
  • You MUST offer Conversion to Permanent (full time or part time) to eligible Casual Employees 
    • after 27th September 2021
      • if employed for 12mths plus
      • if there has been a regular pattern of hours for the last 6mths
      • if the regular pattern of hours would continue
      • the offer must be in writing
  • All new Casuals must be given the CEIS upon employment
  • Conversion eligibility must be assessed on the anniversary of the start date of every single Casual Employee
    • Each casual employee must be given a written notice of offer or reason for not offering -

Superannuation Guarantee for all staff

Quick reminder that from 1 July 2021 the rate of superannuation is increasing to 10%.  This will be automatically adjusted within your Single Touch Payroll Software.
